• “Business Days” – Any weekday excluding Saturdays, Sundays, and official public holidays when banks in Republic of Bulgaria are open for regular business activities.
• “Account” – A registered user profile on the Platform that grants you access to services, features, and tools available through the Website.
• “AI Generation Technology” – The artificial intelligence functionality embedded into our Platform, powered by OpenAI’s API, used to generate content based on user input.
• “Content” – Refers to all forms of material available on or through the Platform, including but not limited to: written text, images, graphics, logos, icons, databases, animations, videos, audio elements, and branding.
• “Digital Item” – A unique piece of digital 3D model or media created using the Platform by submitting Prompts through the AI system.

• “Prompt” – Any instruction, query, or input provided by a user (or generated within the system) that is sent to the API to produce a Digital Item.

All 3D models provided through the Platform are intended strictly for personal, non-commercial use unless otherwise expressly authorized. They do not hold any intrinsic monetary value and may not be exchanged for cash, resold, or transferred. When you acquire a 3D model, you are granted a limited, non-exclusive license to use it for your own personal projects—you do not receive ownership or intellectual property rights to the model itself.

If your account is suspended or terminated for any reason, all associated 3D models will be permanently deleted. These models will not be recoverable, restorable, or eligible for refunds under any circumstance.

Disclaimer: OUR SERVICES ARE DESIGNED FOR PERSONAL, NON-COMMERCIAL USE IN PRIVATE ENVIRONMENTS. THE COMPANY DOES NOT GUARANTEE ANY PARTICULAR OUTCOMES OR FUNCTIONALITY OF THE AI-GENERATED 3D MODELS. YOU AGREE THAT ALL USAGE DECISIONS ARE YOUR RESPONSIBILITY, AND ModelCraft WILL NOT BE LIABLE FOR ANY ACTIONS TAKEN—OR DIRECTED TO BE TAKEN—BASED ON ANY CONTENT OR MODELS YOU ACCESS THROUGH OUR PLATFORM.

6. Your Content

6.1
When you upload or submit any of Your Content to ModelCraft, you grant us a global, non-exclusive, transferable, and sublicensable license to use it. This license allows us to reproduce, display, publish, distribute, and adapt your content, as well as to create derivative works from it, in any current or future media format. You also permit ModelCraft to promote, market, and license Your Content, and to make necessary editorial or technical changes—such as updating metadata or reformatting—to ensure proper management and functionality across our Platform.

This license does not affect your ownership of the original content, but it gives ModelCraft the legal right to utilize it in ways aligned with these Terms.

7. Eligibility Criteria

7.1
Access to and use of the Website and its Services is permitted only for lawful purposes and must comply with all relevant local, national, and international laws and regulations. To use the Platform, you must be at least 18 years old or the legal age of majority in your jurisdiction—whichever is higher.

7.2
By using the Website or any of its features, you affirm that you possess the legal authority and capacity to enter into binding agreements under the laws of your country or region.

By continuing to use our services, you agree to provide such information truthfully and without undue delay. Failure to cooperate may result in your Account being suspended or deleted.

We reserve the right to reject account applications at our sole discretion. Grounds for rejection may include, but are not limited to, breach of our Terms, suspected fraud, unverifiable identity, spam behavior, age restrictions, or use from a restricted jurisdiction.

8.4
Each individual may hold only one active Account at any given time. If you wish to register a new Account, the existing one must first be closed. Individuals previously suspended or banned are strictly prohibited from re-registering under a new identity.

8.5
You are solely responsible for all actions taken under your Account. You must not access any other user’s Account, share login credentials, or grant unauthorized access to your profile. It is your responsibility to safeguard your login details and to alert us immediately if you detect or suspect any unauthorized activity.

If we determine that you’ve breached these Terms, or if any of the information you’ve provided is false, incomplete, or misleading, we may suspend or permanently deactivate your Account without prior notice.

We are not liable for any damages or losses resulting from unauthorized access to your Account, regardless of the cause or origin of the breach.

ModelCraft reserves the right to suspend or permanently revoke access to your Account at any time, particularly in cases involving policy violations, abuse of the platform, infringement of intellectual property rights, or breaches of applicable law. Upon termination, any rights previously granted to access or use our services and content will be revoked.

9. User Responsibilities and Acceptable Use

When using the Platform and its associated Services, you agree to comply with these Terms and all relevant laws. You also agree not to engage in any conduct that could negatively impact ModelCraft, its users, or the functionality of the Services. Prohibited behavior includes, but is not limited to:

• Accessing the Services if you are legally ineligible to enter into this Agreement.
• Reproducing, modifying, translating, disassembling, decompiling, or reverse engineering any element of the Services or Digital Items, unless clearly authorized by law or these Terms.
• Reselling, licensing, distributing, or otherwise commercializing the Services or any derivative content without permission.
• Leasing, sub-licensing, or promoting the Platform or its assets for commercial or marketing purposes without written approval.
• Using the Services for commercial, political, or advertising campaigns not previously approved by us in writing.
• Tampering with or disrupting the Website or its systems, including bypassing security features or unauthorized access restrictions.
• Embedding or incorporating the Services into other products, applications, or software environments.
• Using web crawlers, bots, or other automated technologies to interact with or collect data from the Platform.

• Duplicating, selling, trading, or transferring Digital Items in a manner that breaches our policies.
• Uploading or transmitting files that contain malicious code, violate privacy rights, infringe intellectual property, or include illegal or harmful content.
• Offering professional advice, services, or recommendations without proper qualifications or authority.
• Hindering others’ use of the Services or taking any actions that could damage ModelCraft reputation, infrastructure, or user experience.

9.2
ModelCraft reserves the unilateral right to suspend or terminate your access to the Platform and any Digital Items linked to your Account if we determine that you have violated these Terms or acted in a manner that harms our services, community, or business interests—without any prior warning.

10. Policy Enforcement and Reporting Mechanism

By using our Services, you agree to comply with these Terms and any additional rules or policies set forth by ModelCraft. If you come across content or behavior on the Platform that you believe breaches these Terms, violates our guidelines, or breaks any applicable laws, we encourage you to report it by contacting us at [email protected]. • A clear and reasoned explanation of why the content in question may be unlawful or in breach of our Terms.
• The precise location of the content (such as a URL or reference ID).
• Your full name and a valid contact email.
• A declaration made in good faith affirming that the details you are providing are accurate and complete to the best of your knowledge.

10.2
ModelCraft retains full discretion to enforce its policies and Terms of Use through a range of actions, including—but not limited to—issuing warnings, removing infringing content, limiting platform access, or suspending user accounts. In cases of severe misconduct or repeat violations, we reserve the right to permanently ban access to our Website and Services without prior warning.

11. Transactions

11.1
To complete a purchase of Digital Items via our Platform, you may need to provide specific billing information, such as your credit card number, expiration date, billing address, and contact or shipping details relevant to the order.

11.2
Unless specified otherwise, all pricing information shown on the Website is quoted in euros (EUR).

11.3
Service prices, including those related to Account credit top-ups, may be subject to applicable taxes, fees, or legal duties. You are solely accountable for paying any such charges associated with your use of the Platform.

11.4
All payments must be made using approved payment methods listed on the Website. By submitting a payment, you confirm that you are legally authorized to use the selected payment option. You must ensure all billing details provided are accurate, up-to-date, and complete.

11.5
Depending on your financial institution, you may incur additional charges such as foreign transaction fees, currency exchange costs, or banking service fees. These are imposed by your payment provider and are beyond our control. We do not accept responsibility for such charges.

11.6
Using a credit or debit card without the cardholder’s express permission is strictly forbidden. By making a payment, you confirm that you are authorized to use the method submitted. If a payment fails or is declined, we may cancel your order at our discretion.

We may partner with third-party payment processors to handle transactions, including balance top-ups. These providers operate under their own terms and conditions, and ModelCraft is not liable for any delays, errors, or issues caused by them.

11.8
ModelCraft reserves the right to reject or cancel any order at its sole discretion. Reasons may include item unavailability, pricing mistakes, data inaccuracies in your order, or suspected fraudulent activity.

11.9
Instructions for accessing or downloading purchased Digital Items will be delivered to the email address linked to your Account. Please allow up to 14 calendar days for delivery after payment has been processed. If delivery cannot be fulfilled, we may cancel the transaction and provide a full refund.

12. Top-Up

12.1
In order to purchase AI-generated 3D models on the Platform, you must first fund your Account balance. You can top up your balance using the built-in top-up functionality or other methods we may introduce. All top-up requests are processed via a third-party payment service provider.

12.2
The payment method used for top-ups is subject to the terms and conditions of the respective third-party provider. ModelCraft is not responsible for any processing delays, failures, or technical issues originating from these providers.

12.3
You are solely responsible for entering the correct top-up amount. ModelCraft does not issue refunds, offer exchanges, or make adjustments for any incorrect or accidental top-up amounts.

13. Refunds

13.1
You may be eligible for a refund under certain circumstances, as outlined below:

• Unavailable Digital Items: If a purchased Digital Item cannot be accessed or utilized due to a technical malfunction, please reach out to our support team at [email protected]. If the issue cannot be resolved within five (5) Business Days, a refund will be issued.
• Unauthorized Transactions: Should you detect any charges that were not made or authorized by you, notify us without delay. After reviewing the case, and if unauthorized use is confirmed, a full refund will be granted.
• Billing Errors: If you believe you were incorrectly charged—such as being overbilled—please contact support and include evidence of the discrepancy. If validated, we will process a refund accordingly.
• Platform Protection: We reserve the right to issue refunds at our discretion in cases where fraudulent behavior or actions that compromise the integrity of the Platform are suspected.

13.2
If you are a resident of the European Economic Area (EEA), United Kingdom, or Switzerland, you are legally entitled to withdraw from the purchase of digital content—including Digital Items—within 14 days of receiving access, without needing to provide a reason.

13.3
However, by explicitly agreeing to begin accessing or downloading a Digital Item during this 14-day period, and confirming that you understand this will waive your withdrawal right, you forfeit that right upon starting access.

13.4
To request a cancellation, send a clear notice of withdrawal to [email protected].

13.5
Upon confirming a valid cancellation, we will return your payment using the same method originally used for the transaction unless you request otherwise. Refunds are typically processed within 14 days, but may take up to 30 days, depending on your payment provider. No administrative fees will be applied to the refund.

14. Intellectual Property Rights

Unless expressly indicated otherwise, all materials and content made available through the Platform—including, but not limited to, text, data compilations, graphics, illustrations, visual media, audio files, code, metadata, software components, design elements, and interactive tools—are owned by ModelCraft or its authorized licensors. These assets, along with the Platform itself and any Digital Items, are safeguarded under applicable copyright, trademark, and intellectual property laws.

14.2
Various elements featured on the Platform—such as brand names, icons, logos, taglines, and user interface components—may be registered or unregistered trademarks, trade dress, or service marks belonging to ModelCraft or other parties. The presence of these elements does not confer any license or right for you to use them. Any reproduction, modification, or distribution of such materials without proper authorization may result in legal liability under intellectual property laws.

14.3
All references to third-party trademarks, product names, or company names are used strictly for identification purposes and remain the property of their respective owners. Unless specifically noted, such references do not imply any endorsement, affiliation, sponsorship, or partnership between ModelCraft and the third party.

15. Indemnification

15.1
You agree to defend, indemnify, and hold harmless ModelCraft, along with its affiliates, directors, officers, employees, agents, and authorized representatives, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal and attorney fees) resulting from or related to:

• your access to or use of the Platform;
• any breach or alleged breach of these Terms by you;
• any violation of third-party rights, including intellectual property, privacy, or contractual rights.

This obligation applies to both direct and indirect consequences of your actions and remains in force even after your relationship with the Platform or use of its services has ended.

The Platform, along with all related services, content, and information, is provided on an “as is” and “as available” basis. ModelCraft does not offer any express or implied warranties of any kind, including but not limited to warranties of accuracy, reliability, or uninterrupted access. We do not guarantee that the Platform will function without errors or that it will meet your expectations. By using the Platform, you agree that you do so voluntarily and at your own risk.

17. Limitation of Liability

17.1
To the fullest extent permitted by law, ModelCraft and its affiliates shall not be liable for any loss of income, business, or profits, nor for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or connected to your use of the Platform, its Services, any content, or third-party advertisements. This applies regardless of the legal theory involved (contract, tort, negligence, etc.), even if we were previously advised of the possibility of such damages. This includes, without limitation, damages resulting from reliance on information found on the Platform, system outages, data breaches or losses, deleted files or messages, malware, service disruptions, or external events such as force majeure, fraud, hacking, or technical failures.

17.2
Your choice to use the Platform, interact with third-party content, or view advertisements is entirely at your own discretion. You assume full responsibility for any harm to your device, loss of data, or other consequences that may result from such use.

17.3
Regardless of the nature of your claim, ModelCraft’s total liability to you for all matters arising out of or connected to your use of the Platform, Services, content, or Digital Items will be limited to the total amount you have paid to ModelCraft for those Services. This limitation represents a core part of the agreement between you and ModelCraft.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Bulgaria, and any disputes arising under or in connection with them shall be interpreted in accordance with those laws. However, if you are a consumer residing in a different country, this does not affect any mandatory legal protections granted to you under the laws of your place of residence.

18.2
If you reside in the European Economic Area (EEA) or Switzerland, you have the option to use the European Commission’s Online Dispute Resolution (ODR) platform to seek an alternative resolution for disputes related to online purchases. 19. Miscellaneous

19.1
If ModelCraft does not enforce any part of these Terms at any given time, this shall not be considered a waiver of its right to enforce that or any other provision at a later time. A waiver of one provision does not constitute a waiver of any other provision.

19.2
Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and ModelCraft. Your use of the Platform is not intended to establish any such legal association.

19.3
These Terms, together with the Terms of Use, represent the complete and exclusive agreement between you and ModelCraft, superseding any prior written or oral agreements concerning the same subject matter. If any provision is found to be invalid or unenforceable by a competent legal authority, the remaining provisions shall remain in full force and effect.

19.4
This agreement remains effective until terminated by either party. You may terminate the agreement at any time by ceasing to use the Platform. ModelCraft may terminate your access and this agreement at its sole discretion, with or without notice. Any rights or remedies accrued before termination will remain unaffected. Upon termination, you must stop using the Platform and delete any content obtained from it. Provisions intended to survive termination will continue to apply.

The following sections will remain in effect even after the termination or expiration of these Terms: Sections 14 (Intellectual Property Rights), 15 (Indemnification), 16 (Disclaimer), 17 (Limitation of Liability), 18 (Governing Law and Dispute Resolution), and 19 (Miscellaneous).
